GENERAL TERMS AND CONDITIONS OF SALE

ONLINE SALE OF "WISE" BRAND PRODUCTS

1. OBJECT

The general terms and conditions of sale described below detail the rights and obligations of the company Wise (SAS with a capital of €1,277,900, having its registered office at 3 rue des Bouvières, 74940 Annecy-Le-Vieux, France, and registered with the Annecy Trade and Companies Register under Siret number: 87875626100029) and its Client in the context of the sale of the following goods: Ultra Running Equipment, on the website www.wisetrailrunning.com (hereinafter "the Site"). Any service performed by the company Wise implies the buyer's unreserved acceptance of these general terms and conditions of sale.

2. PRODUCTS

The products offered for sale are described and presented with the greatest possible accuracy. However, Wise cannot be held liable if errors or omissions have occurred regarding this presentation. The 3D photos representing our products are for illustrative purposes only. These photos, as well as the texts illustrating the products, do not form part of the contract. Products sold on the Site will be delivered within 3 business days. This is an estimated timeframe, and Wise cannot be held liable if it is not met.

3. PRICES

The prices presented on the Site are final. They are indicated in Euros (€) and governed by French legislation. They are inclusive of all taxes (TTC - including VAT), except for Clients who have entered a delivery address located outside the European Union (excluding New Caledonia, Switzerland, and Belgium), in which case the displayed prices are exclusive of tax (HT). They are guaranteed subject to typographical or printing errors. These prices exclude the flat-rate contribution to shipping and packaging costs, which remain the responsibility of the Client, except in the case of a temporary or permanent promotional offer. Prices may be modified at any time without notice, particularly in the event of changes in fiscal or economic data. Items will be invoiced based on the rates in force at the time of order registration. Wise does not offer tax refunds (VAT refunds) on its website.

4. ORDER

4.1 Prior identification of the user before ordering To place an order, the user must identify themselves with their email address and password. For any first order, the user must follow an account creation procedure indicated on the website. In case of a lost password, the user can request it again via their customer account. They will then receive their password at the email address provided at the time of registration. The user may also contact customer service by email at contact@wisetrailrunning.com for assistance.

4.2 Recording and validation of the order The user has the possibility to order products directly on the online store. Once the cart has been validated, the user must accept the general terms, choose the address and delivery method, and finally validate the payment method, this last step formalizing the sales contract between Wise and the user. Wise will acknowledge receipt of the order upon validation by sending an email. In certain cases, including payment default, incorrect address, or any other problem with the user's account, Wise reserves the right to block the user's order until the problem is resolved. In the event of the unavailability of an ordered product, the user will be informed by email. The cancellation of the order for this product and its potential refund (only products unavailable at the time of the order can be refunded) will then be carried out, with the rest of the order remaining firm and final. For any questions regarding order tracking, the user must consult their account on the website or contact customer service by email at contact@wisetrailrunning.com.

5. PAYMENT TERMS

Products or services must be paid for in Euros (€). The delivered goods remain the property of Wise until receipt of payment. The transfer of risks takes place upon delivery of the goods. Payment is made upon validation of the order. Order payment is made via:

  • Mastercard

  • Visa

  • Amex

  • Apple Pay

Wise does not accept any other means of payment.

6. ACCEPTANCE OF THE OFFER

Any order constitutes express and irrevocable acceptance of the prices and descriptions of the products available for sale. Validation of the order by the Client constitutes acceptance of the general terms and conditions of sale.

7. INVOICE

The invoice is sent to the email address indicated during the order. It is established in accordance with the rates in force on the day the order is placed. Wise disclaims any liability regarding data entry errors.

8. DELIVERY - TRANSPORT

Throughout the duration of pre-orders, delivery costs are free in metropolitan France. Transport risks are borne by the Client from the time the goods leave the warehouse. The Client must verify the condition of the packaging and the conformity of the delivered items and immediately report any anomaly to Wise if necessary. Any reservations must be noted on the delivery slip presented by the carrier and must be sent within 48 hours by email to: contact@wisetrailrunning.com. If the country of delivery is not part of the European Union, customs duties will be borne by the recipient. Wise has no control over these fees, which are the sole responsibility of the Client.

9. RIGHT OF WITHDRAWAL - RETURNS

If one or more items are not satisfactory, the Client has a period of 30 days from the date of delivery of the goods to exercise the right of withdrawal from the order. The postmark or the date on the delivery receipt constitutes the start date of this period. The return or cancellation may apply to all or part of the order. To do so, the Client must send an email to the following address: contact@wisetrailrunning.com.

Our 30-Day Guarantee begins from the date of delivery of your order. It allows you, if you wish, to return your product if it does not suit you, or if the size, fit, or style is not right. The return must be made in the original packaging or, failing that, in a comparable container and with the item's tags. This guarantee applies to any order placed online or physically at our trade shows. The term of this guarantee expires on the day following the 30th day. Return shipping costs are borne by Wise. This guarantee does not apply if the item is damaged or shows signs of friction/chafing. The item must also be returned clean; if this is not the case, Wise reserves the right not to refund the item and to return it to the client with shipping costs charged.

Our Accident Guarantee covers you for an unfortunate fall. Indeed, for one year, we will repair your item free of charge if it has holes or tears. All effects of friction are excluded from our guarantee. This guarantee takes effect from the date of receipt of the order.

Exchange Guarantee in the first year: Wise offers to replace your item with a new one in the event of a defect or premature wear of your product affecting its functionality. Wear considered superficial is not taken into account in this guarantee, such as flocking that develops a patina, colors that may fade, or friction effects. The date used to apply this guarantee corresponds to that of the initial order. Shipping costs are borne by Wise.

In the second year of the product's life, Wise will prioritize free repair with its partner workshop for a defect inherent to the product.

It is important to note that in all cases, returned products must always be clean. All guarantees mentioned above are also valid overseas and outside the Euro zone, but shipping costs are borne by the Client.

Refunds will be processed within a maximum of 15 business days from the receipt of the returned goods, by re-crediting the payment method used for the purchase, following an inspection to ensure the good condition of the item and its packaging.

In the event that the client is located outside the Euro zone or overseas, the client initiates the return by sending an email to contact@wisetrailrunning.com. Return shipping costs are borne by the Client.

Obligations of the Parties Wise, in the event of acceptance of a pre-order, undertakes to sell and deliver to the Client the products ordered by the latter according to the terms specified above. Wise undertakes to verify that the products comply with French regulations. The Client undertakes to provide Wise with an address where delivery can be made. Providing personal information (name, address, telephone, email address, etc.) collected for the purpose of concluding the sales contract is mandatory. This information is essential for processing and delivering orders and for issuing invoices. Failure to provide this information results in the non-validation of the order. In the event of an error in the provision of this information, Wise cannot be held liable for the impossibility of delivering the product. In this case, the client remains liable for payment. In the event of an incomplete address resulting in the impossibility of delivery by the carrier, the Client must pay the delivery costs corresponding to the reshipment of their order.

ARTICLE 10 - LIABILITY

Wise undertakes to describe the products sold on the Site with the greatest accuracy. Wise cannot be held liable in the event that the non-performance of its obligations is attributable either to the unforeseeable and insurmountable act of a third party to the contract or to a case of force majeure. Similarly, Wise cannot be held liable for any inconvenience or damage inherent to the use of the Internet, including service interruption, external intrusion, the presence of computer viruses, or more generally any case qualified as force majeure by the courts.

Personal Data The collection of the Client's personal data is necessary for processing the order. This information is strictly confidential and is intended only for the use of Wise. In accordance with the Data Protection Act ("Loi Informatique et Libertés") of January 6, 1978, the Client has a right to access, modify, rectify, and delete personal data concerning them. If the Client wishes to exercise this right, they simply need to write to Wise, indicating their surname, first name, and address at contact@wisetrailrunning.com. Wise reserves the right to collect data on the Client through the use of cookies in order to improve the personalized service intended for the internet user.

ARTICLE 11 - MISCELLANEOUS PROVISIONS

The invalidity or unenforceability of any of the clauses of these general terms and conditions of sale or special conditions shall not affect the application or validity of the other clauses of the general terms and conditions of sale. This clause will then be replaced by the closest possible provision. Neither Wise nor the Client may be held liable in the event of contractual non-performance following a case of force majeure, including but not limited to war, riot, insurrection, transport interruption, import problems, strike, shortage, fire, earthquake, storm, flood.
